Girls Gone (false) Accusatory and the sad tale of Florida “justice”

Joe Francis is the genius behind the “Girls Gone Wild” brand and favorite whipping boy of radical feminists and religious repressive’s everywhere (not that there is really a difference). They were all thrilled when two girls accused him of using their footage without their consent. This, they cried, proved their point about what scum he was.

Except it never happened that way.

We may never know the whole story behind why Christina Brose and Brooke Patsolic decides fraud and perjury were good ideas but I suspect the looming hope of a large cash settlement was part of it. What we do know is that they flat out lied. While their lawsuit claimed that they…

“specifically did not consent to any use of their likeness or image.” – quote in context

The reality is far different. In fact there is video of them giving consent.

“You have my full permission to put this on anything, I don’t care,” says Brose, who also gives her full name and age on tape. Brose’s pal, Brooke, also gives her on-camera consent, even pointing out the presence of cops on scene.” – oops, did we really say that?

The girls of course had every reason to believe they could win a lawsuit. Joe Francis was recently blackmailed by a Florida judge who intruded illegally on an civil suit arbitration and kept Joe in jail and literally “under the gun” until his accuser had extorted a settlement from him.

Looking at such a situation, knowing that the legal system was happy to pile on blatantly false charges and act as a strong arm for anyone who wanted a bit of blood from GGW it’s easy to see why a couple of girls (and their families and lawyers) might decide to take their chunk.

“During his 2003 arrest, Joe Francis spent only a few hours in jail. Francis was released by a judge on $50,000 bail. Before he could even exit the jail, he was re-arrested by the same sheriff who arrested him the night before, for a new charge of drug trafficking. Francis had five Vicodins in his shaving kit in his hotel room that he had a prescription for and possessed lawfully. Upon being re-arrested, Francis called from jail and had his doctor and his pharmacy fax a copy of his prescription to the sheriff and the state attorney’s office; nonetheless, they chose to charge Francis with drug trafficking anyway a serious crime calling for penalties of up to 30 years in prison for five of his legally prescribed Vicodins.” – the whole sad tale of prosecutorial misconduct

Once you start lookign into it, things get even more interesting. In a seperate case filed in Florida (the one where the judge was happy to abuse the mediation system)  we find a nice pattern of collusion and backroom deals between business partners that so blurs the line between the legal system and an extortion mill as to render it invisible.

It just so happens that Judge Smoak is the ex-law partner of Ross McCloy, one of the lawyers seeking millions of dollars from Francis for the women in the case. They were both partners in a law firm called Harrison, Sale, Smoak and McCloy. Ross McLoy and Judge Smoak remain close friends. In fact, Ross McCloy gave the keynote speach at Judge Smoak’s confirmation. When lawsuits are filed in the state of Florida, they are randomly assigned to judges. It is improper to file, dismiss and re-file cases in an effort to find a more “favorable” judge. This activity is called “forum shopping.” Ross McCloy filed and dismissed the Francis case before it was finally assigned to his former law partner Judge Richard Smoak.” – collusion? us?

Hell, just go read the whole thing. Of course you wont hear any of this from the folks who think there is something evil about sexy girls (that includes the radfems and the religious nuts) but if you have an IQ and a libido you should be fine.
